This Privacy Policy is governed by the Terms of Use, which includes all disclaimers of warranties and limitation of liabilities. All capitalized terms not defined in this Privacy Policy will have the meaning set forth in the Terms of Use. If you do not agree with this Privacy Policy and Terms of Use discontinue use of the Services.

2. COLLECTION OF PERSONAL INFORMATION
Company may collect and process “personal information” (including without limitation electronic information that could be used to contact you, such as full name, postal address, user name and password, phone number or e-mail address, submitted user content and hashed password and geolocation data) or “demographic and usage information” (i.e. information that you submit, or that we collect through cookies or similar tracking technologies, that is necessary for the proper functioning of our Services, such as the date regarding the start and end and the extent of your usage of the Services, or that relates to your personal interests and preferences), in connection with the Services. For example, when you register for an account, we collect your full name, email address and log in credentials. When you use an artist generated link (collectively, “Masterlinks”), we collect information about your use of the link and your activity associated with the Masterlinks and the Services. Your use of the Masterlinks is governed by this Privacy Policy. When you communicate with us or other users through the Services or otherwise communicate with us by email, we collect information about the communication and any other information you provide in your response. Such information collected by Company may be stored and processed in the United States or any other country in which Company or its agents maintain facilities. If you are an artist and you upload your music to the Services through your account, we collect information, such as your legal name, artist name, the names of other people who have contributed to the music, the album artwork, the genre of music, and your hometown. We internally review this information by automated means and human review to protect against intellectual property infringement and for other fraud prevention and detection purposes.
In addition, third parties may use cookies and similar tracking technologies in connection with our Services, which may include the collection of information about your online activities over time and across third-party websites or online services. The use of this functionality may involve the third-party site providing information to us. We may not control those tracking technologies, and these third-party practices are not subject to our Privacy Policy. We encourage you to review the privacy policies of those third parties carefully. For example, we may provide links on the Website to facilitate your sending a communication from the Website, or we may use third parties to facilitate your interacting with social media sites. 3. USE OF PERSONAL INFORMATION
Company uses your personal information to identify you and, in some cases, to improve and customize the content you see on the Website. Your personal information may also be used by Company for market research, project planning, troubleshooting problems, detecting and protecting against error, fraud or other criminal activity, to enforce the Terms of Use or any applicable Rules, to facilitate your requests, for other internal purposes, and as otherwise described to you at the time of collection. Company will obtain your consent for any use of your personal information beyond those set forth in this Privacy Policy and the original uses for which you provided your consent.
Company may use personal information about you to provide and maintain the Website, analyze Website usage, improve or customize Company’s Services and grow our business, customize the Website’s content, and as otherwise set forth in this Privacy Policy. To the extent permitted by law, you also agree that Company may use your personal information to contact you and deliver information to you that, in some cases, is targeted to your interests, such as targeted banner advertisements, administrative notices, product offerings, and communications relevant to your use of the Services.
Any personal information or content that you voluntarily disclose publicly online (on discussion boards, in chat areas, within your public profile page, etc.) may be collected and used by others. Your username (not your email address) may be displayed to other users when you upload content or send messages through the Website. Any content that you submit to the Website may be redistributed through the Internet and other media channels, and may be viewed by the general public.

4. DISCLOSURE OF PERSONAL INFORMATION
The following describes some of the ways that your personal information may be disclosed in the normal scope of business to provide you with the Services:
Business Partners. Company may share personal information with its business partners to provide, maintain and improve the Services. For example, when one or more of our business partners co-sponsor a service, promotion and/or contest, we may share some or all of the information collected in connection with such service, promotion or contest with the co-sponsor(s).
Artists. Company shares information with artists on the Services, including in connection with their use of Masterlinks. For example, we share aggregate level analytics data with artists for any Masterlinks they generate. In certain circumstances, we may share user level data with artists in accordance with our agreements with those artists. Please note that where an artist obtains any data about you, the artist’s collection and use of such information will be subject to the artist’s own privacy policy and not this Privacy Policy. We encourage you to review the artist’s privacy policy before using any artist’s Masterlinks.
Advertisers. Company may share personal information with advertisers and other third parties for marketing and advertising purposes. As part of this process, we may partner with third parties (such as Facebook) who use cookies and similar tracking technologies to serve targeted advertising/content to you via the relevant third-party platform based on your profile/interests (also known as “interest-based advertising”). Your information may be used by the third-party platform provider to identify your account and serve advertisements to you.
External Providers. There are a number of separate services offered by third parties that Company refers to as external providers that may be complementary to your use of the Services. For example, if you visit a Masterlink, Company uses an API offered through an external provider to assist the artist with processing data for insight into the effectiveness of that Masterlink. If you choose to use these separate services, disclose information to the external providers, and/or grant them permission to collect information about you, then their use of your information is governed by their privacy policy. With your consent, and for your convenience, Company may provide some of your personal information to an external provider offering such services. To prevent Company’s disclosure of your personal information to an external provider, you can decline such consent or simply not use their services. Because Company does not control the privacy practices of these third parties, you should evaluate their practices before deciding to use their services.
Service Providers. Company may engage service providers to facilitate or outsource one or more aspects of Company’s business, products and Services that Company provides to you and, therefore, Company may provide some of your personal information directly to these service providers (e.g. customer care). We contractually prohibit our service providers from retaining, using, or disclosing information about you for any purpose other than performing the services for us, although we may permit them to use information that does not identify you (including information that has been aggregated or de-identified) for any purpose except as prohibited by applicable law. Other Third Party Disclosures. Company may disclose your personal information to third parties for the following purposes: (a) to measure and analyze how you engage with media, (b) to create research insights, reports and analyses, including the composition of the audience that viewed certain content or about the effectiveness of an advertising campaign, (c) to create categories based on demographics, interests and preferences in order to facilitate interest-based advertising.
Google Analytics. Company may use third-party analytics providers to monitor and analyze the use of our Website: Google Analytics is a web analytics service offered by Google that tracks and reports website traffic. Google uses the data collected to track and monitor the use of our Services. This data is shared with other Google services. Google may use the collected data to contextualize and personalize the ads of its own advertising network. Company reserves the right, and you authorize Company, to share or disclose your personal information, including, without limitation, any content, records or electronic communications of any kind, when Company determines, in its sole discretion, that:

you are interfering with Company’s or a third party’s rights or property;
you are violating any applicable law, rule or regulation;
it is necessary or required by any applicable law, rule or regulation; and/or
we receive a lawful request from governmental authorities, including in the event of any investigation, act of terrorism or instance of local, regional or national emergency.
In the event of an actual or proposed merger, acquisition, sale of substantially all of its assets or change of control of Company, personal information collected by Company about you will be considered a business asset and may be transferred to the applicable new entity as part of that process, and we hereby expressly reserve the right to do so. In the unlikely event of our bankruptcy, insolvency, reorganization, receivership, or assignment for the benefit of creditors, or the Website of laws or equitable principles affecting creditors’ rights generally, we may not be able to control how your personal information is treated, transferred, or used.

5. NEWSLETTERS, ETC.
You may unsubscribe from Company’s electronic newsletters or promotional emails at any time by following the instructions contained at the end of every such email, or if a third-party vendor provides Company’s newsletter or promotional emails, in accordance with the instructions provided by such third party. While all efforts are made to ensure this information is viewable in all email browsers, there may be cases where certain email browsers do not display the unsubscribe information correctly. If you are having problems unsubscribing, please email privacy at info@noizyboy.com with the word “UNSUBSCRIBE” in the Subject line and you will be removed within the time required by law. Please note that you cannot opt-out of non-promotional emails, such as those about your account, transactions, servicing, or our ongoing business relations.
6. COOKIES AND TRACKING TECHNOLOGIES
“Cookies” are alphanumeric identifiers in the form of text files that are inserted and stored by your web browser on your computer’s hard drive. Company and third party advertisers may set and access cookies on your computer to track and store preferential information about you. Company and third party advertisers gather information about users through cookie technology. Such information is used within Company’s internal organization and shared with third party advertisers in accordance with this Privacy Policy.
Web Beacons, also known as pixel tags and clear GIFs, (“Web Beacons”), are electronic images that allow a website to access cookies and help track marketing campaigns and general usage patterns of visitors to those websites. Web Beacons can recognize certain types of information, such as cookie numbers, time and date of a page view, and a description of the page where the Web Beacons are placed. Through Web Beacons, we collect general information, such as: Internet browser, operating system, IP address, date of visit, time of visit and path taken through the Website.
Internal use of Web Beacons. Company may use Web Beacons internally to count visitors and recognize visitors through cookies. Access to cookies helps Company personalize your experience when you visit the Website and bring you advertisements off the Website
